Terms of Service

These Terms govern the Gomer Games website and games that link to them (the “service”), operated by Gomer Games LLC (“we,” “us”) from New York, United States. The initial release is intended for US users. These Terms do not override consumer rights or other protections that applicable law does not allow you to waive.

Please read these Terms before using the service. By choosing Create account where these Terms are linked, you agree to them. If you do not agree, do not create an account. Your use of the games is subject to these Terms to the extent permitted by law. Our Privacy Policy explains information handling; agreement to these Terms is not consent to optional advertising or marketing.

Who can use an account

The service is intended for adults and teens. You must be at least 13 to create an account. If you are under 18 or otherwise below the age of legal majority where you live, have a parent or guardian review these Terms and give permission before creating an account. Nothing here removes protections the law gives minors.

Children under 13 must not register or submit an email through the account forms. They may use available guest play with appropriate supervision. Do not misrepresent your age or use someone else’s identity to bypass account restrictions.

Accounts and security

Use an email address you control, provide accurate account information, and keep your password private. Complete email verification when required for account features. You are responsible for your own use of the account; these Terms do not make you automatically responsible for unauthorized activity you did not cause.

Your account has a display name and a permanent player number. Display names are not unique and can be changed. Your email and password, rather than your display name or player number, are used for account access and recovery. A deleted account’s player number is retired and is not assigned to a new account.

Contact security@gomergames.com if you suspect account misuse or a security problem. For account access or deletion help, contact accounts@gomergames.com. We may require verification of account ownership before changing account information or responding to a data request. We will not ask you to email your password.

A Gomer Games account may be used in games that adopt our shared account system. Word Search currently supports account-linked cloud saves. Not every game supports accounts or the same features. Signing in does not guarantee access to future features or synchronization in other games.

Progress, storage, and connectivity

Games keep local scores, boards, progress, and settings on the device and browser used to play. Local data can be lost when site data is cleared, a browser removes storage, a device is lost, or a game or save format changes. Account creation, sign-in, verification, password reset, account deletion, and cloud synchronization need an internet connection.

When you use Word Search with a verified account and completed setup, the game automatically checks and synchronizes its cloud save. If the account has no cloud save, it uploads the existing device progress. When local and cloud saves conflict, the game asks which copy to use; choosing one can replace the other, and the game does not combine conflicting saves. Later progress is uploaded at save checkpoints, with retries when a connection is available. Check the save status before switching devices or clearing local data. See what is synchronized and your choices.

Guests and accounts share one local Word Search save in each browser. Signing out stops account synchronization and leaves that local progress available to the next person using the browser. Signing into another account can offer or upload that progress to the other account. Word Search’s Delete all local data control clears its data from that browser and signs you out; it does not delete the account or its cloud save.

We cannot promise recovery of local progress that has not been uploaded or preservation of every cloud save. Account deletion removes account-linked cloud progress, subject to the deletion and retention details in our Privacy Policy. It does not automatically erase local game data; clear the site’s storage on each device to remove local copies.

Permitted use

We grant you a limited, non-exclusive, non-transferable permission to use the service for personal entertainment in accordance with these Terms. You may share links to the games.

Do not use the service unlawfully, impersonate others, access another person’s account without permission, distribute malicious code, disrupt the service, evade security controls, or deliberately interfere with other users. Do not redistribute, sell, or rehost our protected game code or assets without permission, except where applicable law or an applicable license permits it.

Restrictions in these Terms do not limit rights under third-party or open-source licenses, or rights that applicable law does not allow us to restrict.

Content, brands, and AI-assisted development

Gomer Games LLC and its licensors retain their rights in the service, including protected code, artwork, sounds, text, and branding. Use of the service does not transfer those rights. Please do not use the Gomer Games name or branding in a way that implies our endorsement without permission.

Some development and content creation uses AI tools. We claim ownership only to the extent supported by law and applicable licenses, including rights in human-created contributions and the selection, editing, and arrangement of material. Report an intellectual-property concern to legal@gomergames.com with enough detail to identify the material and your concern.

Third-party services and planned ads

Hosting, authentication, and other supporting functions use third-party providers. Their service availability can affect ours. Our Privacy Policy identifies the current data-handling providers.

We plan to add Google AdMob advertising in a future app release. Ads are not currently active. Any future advertising or paid feature will be explained before it is enabled, including applicable choices and any price or purchase terms. Creating an account today does not agree to a future purchase or supply consent for optional advertising data use.

If future advertising links to another business, that business is responsible for its own products, services, and policies. Its content is not automatically endorsed by Gomer Games LLC. Nothing in this section limits our duties under applicable law.

Suspension, changes, and account closure

We may change, pause, or retire games and features, or restrict an account where reasonably necessary to address misuse, security risks, or legal obligations. We will provide reasonable notice when practical; urgent security or legal action may require an immediate restriction.

You may stop using the service at any time. Use the account deletion control where available, or email accounts@gomergames.com to request closure. See account deletion and retention information. Closing an account does not mean all provider backups or legally required records disappear immediately.

Availability and warranties

The games are in beta and may contain errors or interruptions. To the extent permitted by law, the service is provided “as is” and “as available,” without a guarantee of uninterrupted availability, compatibility with every device, error-free operation, or preservation of every save.

To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. If applicable law requires a warranty or does not permit a disclaimer, that protection remains in effect.

Limits on liability

To the extent permitted by law, Gomer Games LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the service. Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, or any liability or remedy that cannot lawfully be excluded or limited. These limits do not remove our legal data-protection or security obligations.

Health and safety

Read our Health & Safety notice, take regular breaks, and stop playing if you experience discomfort. The games are for entertainment and are not medical advice or treatment.

Governing law and disputes

New York law and applicable United States federal law govern these Terms, without displacing mandatory protections that apply to you. Subject to those protections and legally required jurisdiction or venue, disputes may be brought in courts of competent jurisdiction in New York.

You may contact legal@gomergames.com to try to resolve a legal concern informally. This does not require you to waive a legal claim, use arbitration, or give up a right to complain to a regulator.

Updates and other provisions

We will post revised Terms with an updated date. Material account-related changes will receive appropriate notice, and we will request a new agreement where required. Changes apply prospectively; they do not retroactively remove rights or authorize new data uses.

If a provision cannot be enforced, the rest remains effective to the extent permitted by law. A delay in enforcing a provision does not waive it. These Terms and any additional terms expressly presented for a particular feature govern use of that feature, subject to mandatory legal rights.
